Birth Control Lawsuits: Obama Health Care Mandates Loosen Legal Challenges

NEW YORK -- The legal challenges over religious freedom and the birth control coverage requirement in President Barack Obama's health care overhaul appear to be moving toward the U.S. Supreme Court.

Faith-affiliated charities, hospitals and universities have filed dozens of lawsuits against the mandate, which requires employers to provide insurance that covers contraception for free. However, many for-profit business owners are also suing, claiming a violation of their religious beliefs.

The religious lawsuits have largely stalled, as the Department of Health and Human Services tries to develop an accommodation for faith groups. However, no such offer will be made to individual business owners. And their lawsuits are yielding conflicting rulings in appeals courts around the country.

"The circuits have split. You're getting different, conflicting interpretations of law, so the line of cases will have to go to the Supreme Court, `' said Carl Esbeck, a professor at the University of Missouri Law School who specializes in religious liberty issues.

Last year, the Supreme Court ruled that Obama's fiercely contested health care overhaul, known as the Affordable Care Act, was constitutional. But differences over the birth control provision in the law have yet to be resolved.

Under the requirement, most employers, including faith-affiliated hospitals and nonprofits, have to provide health insurance that includes artificial contraception, including sterilization, as a free preventive service. The goal, in part, is to help women space pregnancies as a way to promote health.

Religious groups who employ and serve people of their own faith ? such as churches ? are exempt. But other religiously affiliated groups, such as Catholic Charities, must comply.

Roman Catholic bishops, evangelicals and some religious leaders who have generally been supportive of Obama's policies have lobbied fiercely for a broader exemption. The Catholic Church prohibits the use of artificial contraception. Evangelicals generally permit the use of birth control, but they object to specific methods such as the morning-after contraceptive pill, which they argue is tantamount to abortion.

Obama promised to change the birth control requirement so insurance companies and not faith-affiliated employers would pay for the coverage, but religious leaders said more changes were needed to make the plan work.

The Health and Human Services Department said it could not comment on litigation. A spokeswoman also did not respond to a question about when the latest revisions in the birth control rule would be made public.

However, government attorneys responding to a lawsuit said an announcement was expected by the end of March. In the suit filed by the evangelical Wheaton College in Illinois and Catholic Belmont Abbey in North Carolina, the court ordered government attorneys to provide a progress report on the new rule every 60 days. Whatever its final form, the mandate will take effect for religious groups in August.

At the center of the cases is the Religious Freedom Restoration Act, the 1993 law that bars the government from imposing a substantial burden on the exercise of religion for anything other than a compelling government interest pursued in the least restrictive way. The question of how or whether these criteria apply when owners of for-profit businesses have a religious objection to a government policy hasn't been fully tested.

"It's more natural for people to say Notre Dame exercises religion, but when you say this power tool company exercises religion, you have to explain it little more, I think the claims are really the same," said Kyle Duncan, general counsel for the Becket Fund for Religious Liberty, which represents many of the plaintiffs.

Brigitte Amiri, senior staff attorney at the American Civil Liberties Union, argued the business owners are trying to use a religious liberty claim to deny benefits to someone else.

"We don't think that religious liberty claims can be used as a way to discriminate against women employees ? using those claims to take away someone else's benefits and services," Amiri said.

In the lawsuits from faith-affiliated groups, such as the University of Notre Dame, judges around the country have generally said it would be premature to decide the legal issues until the federal rule for religiously affiliated organizations is finalized.

In the cases involving business owners, judges have granted temporary injunctions to businesses in nine of 14 cases they've heard, while questions about for-profit employers and religious rights are decided, according to a tally by the Becket Fund.

In a case brought by Cyril and Jane Korte, Catholic owners of Korte & Luitjohan Contractors in Illinois, a three-judge panel granted a temporary injunction, ruling 2-1 that providing employees insurance coverage that includes birth control would violate the Kortes' faith.

"It is a family-run business, and they manage the company in accordance with their religious beliefs," the judges wrote.

The dissenting judge argued that the company will not be paying directly for contraception but instead will purchase insurance that covers a wide range of health care that could include birth control, if the woman decides with her physician that she needs it.

"What the Kortes wish to do is to preemptively declare that their company need not pay for insurance which covers particular types of medical care to which they object," the dissenting judge wrote.

Similar reasoning was used by courts denying an injunction requested by the arts and crafts chain Hobby Lobby and religious book-seller Mardel Inc., which are owned by the same evangelical family. Oklahoma-based Hobby Lobby calls itself a "biblically founded business" and is closed on Sundays.

The U.S. district judge who first considered the request said, "Hobby Lobby and Mardel are not religious organizations."

"Plaintiffs have not cited, and the court has not found, any case concluding that secular, for-profit corporations such as Hobby Lobby and Mardel have a constitutional right to the free exercise of religion," the ruling said.

Hubble finds appearances can be deceptive: Looking at the stars in NGC 411

Jan. 26, 2013 ? Globular clusters are roughly spherical collections of extremely old stars, and around 150 of them are scattered around our galaxy. Hubble is one of the best telescopes for studying these, as its extremely high resolution lets astronomers see individual stars, even in the crowded core. The clusters all look very similar, and in Hubble's images it can be quite hard to tell them apart -- and they all look much like NGC 411, pictured in a new image.

And yet appearances can be deceptive: NGC 411 is in fact not a globular cluster, and its stars are not old. It isn't even in the Milky Way. NGC 411 is classified as an open cluster located in the Small Magellanic Cloud, a small sister galaxy near our own. Less tightly bound than a globular cluster, the stars in open clusters tend to drift apart over time as they age, whereas globulars have survived for well over 10 billion years of galactic history. NGC 411 is a relative youngster -- not much more than a tenth of this age. Far from being a relic of the early years of the universe, the stars in NGC 411 are in fact a fraction of the age of the sun.

The stars in NGC 411 are all roughly the same age, having formed at one time from one cloud of gas. But they are not all the same size. Hubble's image shows a wide range of colors and brightness in the cluster's stars; these tell astronomers many facts about the stars, including their mass, temperature and evolutionary phase. Blue stars, for instance, have higher surface temperatures than red ones.

The image is a composite produced from ultraviolet, visible and infrared observations made by Hubble's Wide Field Camera 3. This filter set lets the telescope "see" colors slightly further beyond red and the violet ends of the spectrum.

MARIBOR, Slovenia (AP) ? Lindsey Vonn showed she can beat Tina Maze in the Slovenian's best discipline and on her home snow.

While it may be too late to challenge her biggest rival for the overall World Cup title, Vonn is looking like Maze's biggest challenger at next month's world championships.

The American proved that she has fully recovered from a recent illness by winning a World Cup giant slalom, her second win in two weeks.

Vonn was third behind Maze after the first run but overcame several errors in the second to put down the fastest time and create a margin that Maze couldn't overcome. Vonn won in 2 minutes, 22.2 seconds for her first GS victory since last March.

"In the second run I decided, OK, it's all or nothing, I had to go for it," Vonn said. "It's been a rough year for me in GS, so it's just perfect."

Maze still clinched her third giant slalom discipline title by placing second. Maze had a near-perfect first run, but a poor start to the second cost her valuable time and she finished 0.08 seconds behind Vonn.

With her 59th World Cup win overall, Vonn's just three away from equaling Annemarie Moser Proell's record on the women's side. She earned her first GS victory since last March and back-to-back wins after taking the downhill last week at Cortina D'Ampezzo.

Vonn took nearly a month off over the holidays to recover from an intestinal illness that landed her in the hospital in November. While her break allowed Maze to build an even bigger lead in the overall standings, Vonn said it's clear she made the right decision.

"A couple of weeks ago, everyone was thinking I was crazy taking this time off," Vonn said. "But I felt my body wasn't ready. Now I am ready."

Austria's Anna Fenninger was third, 0.57 seconds behind Vonn.

Maze's closest rival in the GS, Kathrin Zettel, only managed sixth. Maze is 238 points ahead of Zettel with just two GS races remaining this season.

Maze also extended her lead in the overall standing to 748 points against her closest challenger, Germany's Maria Hoefl-Riesch, who finished fourth. Vonn stands another 66 points back in third, having missed several races while sidelined.

The 29-year-old Maze performed in front of a passionate home crowd and was 0.48 seconds ahead of Vonn after dominating the first run.

However, she ran wide at the start of the second, leaving her 0.13 seconds behind her rival at the first checkpoint. Despite the cheers of the fans urging her on, Maze couldn't make up the time and finished with tears in her eyes.

"I had a mistake in the flat part," Maze said. "In my final run, I just had too many mistakes but I am very satisfied with second."

Maze has won four of the seven giant slaloms this season, making the podium in the other three.

"I have been working so hard this year for this GS crystal globe," she said. "Now I've won it, I feel freed and can look forward."

While the overall World Cup title may be Maze's to win or lose, Vonn will be a favorite to dominate next month's world championships in Schladming, Austria.

5.2 PTR datamining has come up with four new fishing pets! All fish. :P

If these fish companions share the same model as the Tiny Goldfish and Fishy, we'll finally have all(?) the colors of this particular pet model. The skins are actually pretty lovely IMO, so I'm looking forward to collecting these four!

Raleigh, N.C. ? United Arts Council of Raleigh and Wake County and the Greater Raleigh Chamber of Commerce have named recipients of the annual Business Support of the Arts Awards, recognizing outstanding contributions to the arts in our area by businesses, organizations, and individuals. Awards are given in four categories: large business, small business, individual and arts education. The Business Support of the Arts Awards were presented on January 16, at the 3rd Annual State of the Arts and Culture in Wake County event at the North Carolina Art Museum.

The Large Business category winner, Wyrick Robbins Yates and Ponton, LLP, and its 100+ employees enrich Raleigh and Wake County through their participation in arts organizations. As good corporate citizens of this community, they have a long tradition of community service and encourage all employees?not just the attorneys?to get involved and contribute in whatever ways are most appropriate. Employees have served in leadership roles on many arts-related boards in Wake County, including the United Arts Council, Carolina Ballet, Burning Coal Theatre, Arts Together and more. Through the economic downturn of the past several years, Wyrick Robbbins has continued to support arts education during a critical time in arts funding. They have contributed to the Visual Art Exchange, NC Theatre, artspace, Carolina Ballet, Burning Coal, United Arts Council, among others. Recipient of the award in the Small Business category is National Pawn, owned by Bob Moulton. For the second year in a row, National Pawn has donated more than 100 instruments to the middle school band and orchestra programs in the Wake County School System. National Pawn, under Mr. Moulton?s guidance, has extended support to school systems in Durham, Orange and New Hanover counties, as well. Additionally, Mr. Moulton, a self-described ?proud former band geek,? provided a cash contribution to Wake County to repair the donated instruments, as well as donating 100 brand new recorders that have been distributed to a high-poverty school in Wake County.

Mr. Moulton wants to help as many students as possible realize their dreams of becoming musicians. His efforts are focused on raising awareness of the tremendous need for used instruments and the potential of recycling. He encourages community members to search their closets for instruments no longer used and to bring them to his shops to donate or sell, so that they may be redistributed to students. In a growing school system with limited resources, the arts program relies on support from community partners. These donations help to ensure that students who might not be able to provide their own instrument will still have access to music class. Participation in the arts develops the 21st-century skills of communication, creativity and collaboration, making Mr. Moulton?s generosity an investment in our future. Throughout its history, Arts Education winner, The Raleigh Fine Arts Society, has promoted and encouraged artistic pursuits in our community. Through lectures, exhibitions, concert and recitals, The Raleigh Fine Arts Society has endeavored to foster public interest in art, music and literature. Its major focus has been on three signature projects:

The North Carolina Artists Exhibition Adopted as the first Society project in 1965, the Artists Exhibition has now grown into an annual juried exhibition for artists throughout the state, with a nationally recognized art curator or educator invited to serve as juror each year. Officially named the North Carolina Artists Exhibition in 2008, during its 30th anniversary year, the exhibition is held in the Betty Ray McCain Gallery at the Progress Energy Center for the Performing Arts. This year, the Society added an important educational component to this project in the form of a DVD presentation for area high schools distributed free of charge. The DVD is intended to encourage and inspire the next generation of NC artists, offering a behind-the-scenes look at a juried art exhibition with insight provided by participating artists and the juror.

The Literary Contest The Literary contest was launched in November 1978 as a short story contest among high school students, juried by professionals and featuring cash awards for prize winners. This short-story competition for Wake County high school students encourages creative writing and recognizes emerging talent. An important part of the contest is the Young Writer?s Workshop where the final judges share their evaluations and provide feedback to the authors of the winning manuscripts. Following the workshop, the winners are honored at an Awards Banquet. In 2012, 913 short stories were submitted from 19 Wake County public and private high schools. Eighteen winners from seven schools were selected.

The Choral Competition In 1999, the Choral Competition was created to showcase choral music at the elementary school level. Elementary school choral groups and their teachers are offered a unique opportunity to perform and share their skills with other schools and the public at Meymandi Hall in the Progress Energy Center for the Performing Arts. The Celebration promotes the highest standards for excellence in children?s choral singing. It is the only chance available in Wake County for many of these children to present a musical program in a professional setting and to observe other choral groups. Choral directors receive feedback from qualified adjudicators, enabling them to improve future performances. In spring 2012, students from 16 schools performed on two consecutive evenings; approximately 1000 elementary students sang for an audience of 3000. (Nominated by Peggy Wilks)

The honoree in the Individual Category is Elizabeth Beam. Ms. Beam serves as the group leader for the Cardinal Singers, a ladies vocal chorale that performs throughout the community. The Cardinal Singers provide numerous free concerts for senior adult clubs sponsored by the Raleigh Parks and Recreation Department, as well as special concerts open to the public throughout the year. Ms. Beam has served faithfully as the group leader for more than 20 years. She coordinates their concert and performance schedule, develops the content of each performance, and reaches out to the senior community to make the group available for concerts. Her energy and enthusiasm permeates through the group and her passion and love of music is evident.

In typical fashion, Ms. Beam places the emphasis on The Cardinal Singers, describing them as unsung (pun intended) heroes with the seniors in the community. They have been around over 30 years and except for receiving the Fred Fletcher Award of Excellence for Volunteering, they have quietly done what they do so well ? providing high quality programming free of charge, traveling to 25 or so groups each season. Ms. Beam notes that besides the senior clubs, her group has sung for naturalization ceremonies including the one at the International Festival this past fall. Ms. Beam describes the chorale as ?a life style for the singers?probably a quarter of the group is made up of retired/working music teacher/choir directors. Government to unveil energy efficient vehicle (EEV) policy by first ...

Much has been said about making Malaysia a hub for energy efficient vehicles (EEV), and the government will unveil policies on EEVs by the first half of this year, Bernama reports.

Minister of International Trade and Industry Datuk Seri Mustapa Mohamed said that this would provide good opportunities and a level-playing field for local and foreign players in the industry.

?This is one of the segments that we think is important under the ongoing revised National Automotive Policy (NAP). We have decided this is the segment that we need to open up in the near future,? he said at the launch of KLIMS 13 at PWTC yesterday.

He said the government is ironing out policy details such as on technology, fuel emission, standards and quality, adding that Malaysia is the only ASEAN country focusing on the EEV market. From the latter part of the above statement, we know that the government?s definition of EEV excludes small and cheap fuel-efficient non-hybrid cars that Thailand?s Eco Car programme is all about.

?All the stakeholders in the automotive trade have agreed on two things ? that we should make the production and marketing of EEV the future focus of the industry and that we should seek to establish a leadership position in the region for this sub-sector,? he said.

The minister said that although the government has not announced the final shape and form of the revised NAP, it will first roll out pre-packaged customised incentives to support the development of the EEV sub-sector. This is all part of the transition period towards the opening up of the automotive market in 2015-2016.

?With 2015 and 2016 around the corner, everyone in the motor sector is aware that they have to open up, and all of them are gearing up to face new reality and new competition,? he added.

In July 2012, Honda Malaysia announced that it will be producing hybrid vehicles in Malaysia, starting with the CKD Jazz Hybrid that was launched in November. With a concrete EEV policy in place, the government will be hoping more carmakers follow suit.

Foo Fighters Dave Grohl and Taylor Hawkins will induct Rush and hall of fame member Don Henley will induct Randy Newman at the April 18 ceremony in Los Angeles.

Public Enemy and Heart will also enter the hall of fame, along with lifetime achievement award winners Quincy Jones and Lou Adler. More performers and presenters will be announced later.

Tickets for the ceremony go on sale to the public Feb. 1. It will be broadcast May 18 on HBO.

Strong start to earnings lifts British shares

LONDON, Jan 23 (Reuters) - Britain's top share index rose on

Wednesday with strong earnings from Unilever marking a positive

start to the full-year results season.

The global consumer goods firm alone provided

almost three points of a seven point gain on the FTSE 100 index

, its 2.7 percent rise in strong volume leading blue-chip

gainers.

Unilever earlier reported underlying sales growth of 6.9

percent for 2012, beating forecasts of 6.5 percent, propelled by

double-digit growth in emerging markets.

"They've put in a stellar set of results," Basil Petrides,

trader at Hartmann Capital, said, although with the stock at

all-time highs, he was looking for a dip before buying.

At 1132 GMT, the FTSE 100 index was up 6.86 points, or 0.1

percent, at 6,186.03 points. Ex-dividend factors clipped 1.97

points off the index, with contractor caterer Compass Group

and utility Scottish & Southern Energy both

trading without entitlement to their latest payouts.

BHP Billiton also lent strength after posting

results, up 1.1 percent and providing 2.4 points of the index's

gains.

The global miner boosted iron ore output by 3 percent in the

December quarter, racing to supply more of the raw material to

Chinese steelmakers despite signs of a softening market.

BHP's advance helped to lift the heavyweight mining sector

to gains of 0.3 percent.

This week has seen the earnings season - already well under

way in the United States - start in earnest in Europe.

In the U.S. so far, 68 percent of companies have met or

beaten expectations, with 61 percent of UK companies at least

meeting expectations.

The Standard & Poor's 500 index rose to a fresh

five-year closing high on Wall Street on Tuesday after Google

and IBM posted encouraging results.

"We're still in a bull market on the FTSE. All the focus is

on the U.S. earnings, which have been surprisingly good, and

that's what's driving the markets at the moment, with decent

earnings from the UK supporting sentiment as well," Fawad

Razaqzada, market strategist at GFT, said.

"There is no reason that the market should be going down at

this stage."

Global stocks were also supported after Republican leaders

in the U.S. House of Representatives said they aimed to pass a

bill to extend the U.S. debt limit on Wednesday.

The White House said this would remove uncertainty about the

issue, although Razaqzada said that while the move was

supportive, some sort of a deal to avoid catastrophic default

was already priced in.

Black patients with hypertension not prescribed diuretics enough, study suggests

Jan. 22, 2013 ? A research study of more than 600 black patients with uncontrolled hypertension found that less than half were prescribed a diuretic drug with proven benefit that costs just pennies a day, report researchers at Weill Cornell Medical College and the Visiting Nurse Service of New York's (VNSNY) Center for Home Care Policy and Research. The researchers say these new findings should be taken as a serious wake-up call for physicians who treat black patients with hypertension.

Their study, reported in the American Journal of Hypertension, found that the patients in the study who used the common diuretic drugs had, on average, lower blood pressure (both systolic and diastolic) than the patients who did not receive them.

"We were surprised to find that this beneficial and low-cost drug was not being prescribed for more patients who would benefit from it," says the study's lead investigator, Dr. Linda Gerber, a professor of public health and director of the Biostatistics and Research Methodology Core at Weill Cornell Medical College.

Many previous studies have shown that diuretics are particularly helpful in black patients with hypertension and should be used as first or second-line treatment -- findings that have been written into treatment guidelines. Also, several recent clinical trials have reported that newer classes of agents are not superior to the older diuretic agents, especially in blacks. Newer drugs for hypertension include angiotensin-converting enzyme inhibitors (ACEs), angiotensin-receptor blockers (ARBs) and calcium-channel blockers (CCBs).

"Yet, we find that physicians are not using the drugs as they should in a population that is especially hard hit by high blood pressure, and who suffer greater prevalence, severity, organ damage and mortality from the disease compared to other groups," says Dr. Gerber, who is also a professor of epidemiology in medicine at Weill Cornell.

While Dr. Gerber did not speculate on why this phenomenon is occurring since doctors were not interviewed as part of this research, study co-author, Dr. Samuel Mann, a professor of clinical medicine at Weill Cornell and a hypertension specialist at the Hypertension Center of NewYork-Presbyterian Hospital?Weill Cornell Medical Center, has some theories.

"Guidelines are not rules and they are not enforceable, and some physicians may worry about potential side effects of diuretics -- which, although not uncommon, are not a major problem. And in patients with uncontrolled hypertension, the benefit of treating with a diuretic far outweighs the risk of side effects that are generally very manageable," says Dr. Mann. "Also, newer drugs are promoted much more aggressively than diuretics. However, many studies show that diuretics work very well, particularly in black patients, so between their effectiveness and low cost, their use should be a no-brainer."

The Weill Cornell research team worked in close collaboration with researchers from the VNSNY Center for Home Care Policy and Research, who received funding support from the National Heart, Lung and Blood Institute (NHLBI) to seek ways to improve hypertension management and outcomes. 658 black patients receiving home care were enrolled in the study; all had uncontrolled hypertension defined as 140/90 or above (130/80 or above if they were diabetic). Although the patients were receiving post-acute care from a single health organization, their prescribing providers came from a wide variety of medical settings.

"Communicating effectively with patients' physicians and persuading them to review the medications of patients with uncontrolled hypertension is an ongoing challenge for home care nurses," says study co-author Dr. Penny Feldman, director of the VNSNY Center for Home Care Policy and Research and senior vice president for Research and Evaluation at VNSNY. "Our study shows that close monitoring of patient medications can help identify inconsistencies and divergence from current approved medical guidelines and make inroads to help improve the health and quality of life of black patients with hypertension."

Study investigators found that 5.5 percent of participants were not prescribed any antihypertensive drugs, and that only 46 percent were prescribed a diuretic. They also discovered that participants who were not taking a diuretic had systolic and diastolic blood pressures that were, on average, five and four millimeters higher, respectively, than those who were taking a diuretic.

"A majority of patients surveyed were taking multiple drugs for hypertension, as many as three or four, and many of those still were not taking a diuretic," says Dr. Gerber. "The absence of diuretic use in the regimen of more than half of the patients in this study is contrary to guidelines and may be harmful to patients, both medically in terms of uncontrolled hypertension, and economically, in terms of medication cost and compliance."

Dr. Gerber adds that a strength of the study is that "it focuses on members of an undertreated and understudied population whose high blood pressure has proven particularly damaging, and for whom guidelines strongly recommend a diuretic as a mainstay of treatment."

CBS News Chairman Jeff Fager and president David Rhodes say Rice "will use her insight and vast experience to explore issues facing America at home and abroad."

Rice served as secretary of state during President George W. Bush's second term. She was the first African-American woman to hold the post.

Rice was Bush's national security adviser during his first term and worked on the National Security Council under President George H.W. Bush.

U.N. report finds torture of Afghan detainees, secret sites

KABUL (Reuters) - Almost a third of all detainees recently transferred to Afghan control have been tortured and Afghanistan's spy agency is operating secret facilities to avoid international scrutiny, a United Nations report released on Sunday said.

The findings could complicate the already thorny issue of how to manage the security transition ahead of the withdrawal of NATO-led troops from Afghanistan by the end of next year. Hundreds of detainees are being transferred from NATO to Afghan control as part of that transition.

Based on interviews with hundreds of detainees between October 2011 and October 2012, the 139-page report found "credible and reliable evidence" that more than half of those interviewed experienced torture or abuse.

Of the 79 detainees interviewed who were transferred from NATO to Afghan control during the 12 months, 25 were tortured, a rise of seven per cent over the previous year's report.

"The (Afghan) government's efforts to address torture and those of ISAF (NATO's International Security Assistance Force), although significant, have not resulted in a marked improvement and reduction in the use of torture," said the report.

"This raises concerns at a time when the government is taking over almost full responsibility for conflict-related detainees from international military forces."

The European Union said in a statement it was "deeply concerned" by the report and urged the Afghan government to "bring the perpetrators of such acts to justice".

A spokesman for the National Directorate of Security (NDS) referred Reuters to President Hamid Karzai's office for comment. Karzai's spokesman said a statement would be released on Monday.

The U.N. Assistance Mission in Afghanistan (UNAMA) interviewed 635 conflict-related detainees held at 89 facilities across Afghanistan by Afghan security forces and the NDS.

The report is the second by UNAMA to highlight widespread abuse within the Afghan detention system.

The United States and other ISAF nations halted transfers to nine Afghan-run facilities after the mission's October 2011 report alleged that hundreds of detainees -- including children -- held by NDS and the Afghan security forces were tortured or abused.

"This situation raises continuing concerns about states' legal obligations prohibiting them from transferring detainees to another state's custody where a substantial risk of torture exists," Sunday's report said.

NATO-led forces in Afghanistan have been handing over detainees to Afghan control gradually ahead of the withdrawal of most international forces.

The report outlines a harrowing list of fourteen methods of torture, including beatings with pipes and wooden sticks, twisting of genitals, extracting fingernails, electric shocks and threats of execution and rape.

The report also includes a statement by an unnamed NDS official in Kabul who confirmed the agency's use of torture and secret facilities for detainees.

"NDS has several secret places in which they detain and torture people," the official said.

The official said NDS intentionally moved tortured prisoners to their headquarters in Kabul to evade outside scrutiny.

"All tortured detainees were taken out of their cells that are located in one building and they were transferred to another building inside the same compound to hide them."

Bernanke says raising the debt ceiling is critical

ANN ARBOR, Michigan (Reuters) - Federal Reserve Chairman Ben Bernanke on Monday urged U.S. lawmakers to lift the country's borrowing limit to avoid a potentially disastrous debt default, warning that the economy was still at risk from political gridlock over the deficit.

Likening Congress to a family arguing that it can improve its credit rating by deciding not to pay its credit card bill, Bernanke said that raising the legal borrowing limit was not the same as authorizing new government spending.

"It's very, very important that Congress takes the necessary action to raise the debt ceiling to avoid a situation where our government doesn't pay its bills," he told an event sponsored by the University of Michigan.

The U.S. Treasury says the country bumped into its borrowing limit on December 31, and it is now employing special measures to enable the government to meet its financial obligations.

U.S. leaders did agree at the beginning of January to extend tax cuts for all American families earning less than $450,000 a year to avoid a portion of a "fiscal cliff" of policies that Bernanke had warned would likely tip the economy into recession.

But lawmakers must still navigate the debt limit as well as thrash out a deal over drastic automatic spending cuts that were postponed until March 1.

"We're not out of the woods because we are approaching a number of other fiscal critical watersheds coming up," Bernanke warned on Monday.

The Fed last month opted to keep buying $85 billion worth of Treasury bonds and mortgage-backed securities a month until it saw a significant improvement in the labor market outlook, in an aggressive bid to push down borrowing costs and spur hiring.

It has held interest rates at nearly zero since December 2008 and has said it will keep them at this ultra-low level until unemployment reaches 6.5 percent, provided that inflation does not look likely to breach a threshold of 2.5 percent. U.S. unemployment in December remained at a lofty 7.8 percent.

The president of the San Francisco Federal Reserve Bank, John Williams, said earlier on Monday that he expected the central bank's bond buying would be needed "well into the second half of 2013."

Minutes from the Fed's December 11-12 policy meeting released earlier this month showed several policy makers favored ending the bond purchases well before the end of this year, while a few officials thought the purchases would be warranted until the end of 2013.

A third policy-maker who spoke on Monday, Dennis Lockhart, president of the Atlanta Federal Reserve Bank, stressed that the open-ended, or meeting-to-meeting nature, of the Fed's commitment to buy assets did not mean the policy would continue indefinitely.

"'Open ended' does not mean 'without bound.' The program is not 'QE Infinity,'" he told the Rotary Club of Atlanta.

Do they never do controlled burns to reduce the burden of undergrowth? Seems like they keep having large bush fires threaten important stuff.

One wonders if this is Environmentalism run amuck of putting out all fires until instead of number of small natural fires that don't do significant damage, the fuel builds up into inferno range that does great damage?

Or you could just clear the brush around your observatory regularly -- again if the Environmentalists let you. Australia is rather weird in this regard.

Well, 10 years ago to the week, Mount Stromlo Observatory burnt down. The owners of that also own Siding Spring, and put in place many measures. Like clearing trees, and installing fire mesh on all the windows.

Problem is, the flash point of eucalyptus oil is 47 degrees, so on hot days the country is basically guaranteed to erupt in a massive fireball. Fireballs have been observed rolling along bare earth for a km, just igniting the volatile oils above the ground layer in the air.

Other problem is that we've had record rains for 2/3 years so burnoffs couldn't really be done. And now we're back in a record hot spell, and everything has completely dried out in the past 6 months now that La Nina is back. It went from too wet to burn off to too volatile to burn off in a blink of the eye (and since there are government organisations involved, it could be argued they can't act that quickly:) .

Most buildings on the mountaintop are 1970's era. The main 3.9m dome has no active fire safety equipment in it, but it is clad in fire proof material and was always intended as the fire safety refuge for the entire mountaintop, since there's only a single winding road off the mountaintop (which always scared the hell out of me in Summer).

The lodge on the other hand had wooden doors, was quite up close to the bush (a feature, because it moderated the temperatures for the astronomers sleeping during the daytime), and was sorely lacking in maintenance (although when I worked there, I could hear workman on the roof often enough, so I presume they were clearing leaves and twigs from the roof).

Fortunately, yesterday was Sunday. The photos the guy on duty took just before leaving look awfully scary to me, but he's a firey, and knows what he's doing. Might have been interesting to get all 18 staff and x number of visiting astronomers off the mountain in a hurry if it was a week working day the bus was back in town and not available when the evac was called. Not much room to land a chopper (although it's been done before).

"Aaron Swartz's death is a loss for all humanity," Jacob Applebaum, a distinguished hacker, said by email to me today.

He was a "Web genius," wrote Lawrence Lessig, the Harvard Law School professor and director of the Edmond J. Safra Center for Ethics at Harvard University.

But just after Swartz died, on Friday, Lessig had wondered about another epithet used to describe him. ?This government," Lessig said needs to answer is why it was so necessary that Swartz be labeled a ?felon.?

Aaron Swartz was a hacker-activist and a committed liberator of information. Facing federal charges, a possible sentence of 35 years in prison and a $1 million fine, for downloading subscription-only academic papers with the intent to distribute them, Swartz hanged himself in his apartment in Brooklyn on Friday. He was 26.

Sample papers Swartz attempted to set free include "John Berryman: The Poetics of Martyrdom" and "Mapping the Niger, 1798-1832: Trust, Testimony and 'Ocular Demonstration' in the Late Enlightenment." On its own initiative, JSTOR, which hosts the academic papers and never pressed charges against Swartz, started offering limited free access to its archive just this week.

If Swartz's death plunged his admirers and colleagues into deep mourning, it also activated their fury. Though his suicide had no doubt many causes, Swartz may have come as close as anyone in recent memory to dying for a political movement. Those over 40 will have to think back to counterculture martyrs of the early 60s to find a comparably galvanizing figure in the current circle of hacker-activisits. The prodigy developer, at 14, of RSS feeds, Swartz also agitated without cease?or compensation?for the free-culture movement.

Two years ago, in January, 2011, Swartz was arrested for, essentially, setting information free?as an animal-rights activist might liberate a zoo. In 2008, he had thrown open PACER, a subscription-only trove of federal judicial documents. And then he had downloaded the 4.8 million articles from JSTOR. Of course, thanks to the magic of electronic reproduction, the articles still exist on the JSTOR site.

Swartz was charged, then, with wire fraud, computer fraud, unlawfully obtaining information from a protected computer and damaging a protected computer.

"I don't fully understand the reasons that he took his own life," Applebaum, who worked with Swartz on security projects, told me. "If it has to do with the thought of nearly endless pain of prison for working toward an open culture, I empathize with the goals and certainly with the stress." (Applebaum was himself the subject of a federal investigation for his connection with Wikileaks.)

"Such a jackboot on one's throat creates atomized people, which contributes to deep despair and depression."

As Applebaum and Lessig eulogize their hero, it's time a wider audience appreciate his achievements. Applebaum cites especially Tor2Web, Swartz's security project, and his Guerrilla Open Access Manifesto. The Manifesto, which lays out Swartz's politics, should be required reading for anyone seeking to understand the open-culture movement. Because Swartz didn't believe in ownership of information, his manifesto is unsigned.

Enchanted Homeschooling Mom: The ABC's of Homeschooling ...

I will be finishing my discussion on the topic of homeschooling today. Please note that due to the lengthy topics I will not be able to cover all topics in full detail so please feel free to comment on the posts or email me. If you are a blogger and have an article that you think fits a certain topic please email me with the link and I will be more than happy to include your link in my ABC?s of Homeschooling 5 day series. ?Here are today?s final additions to the series?

It is vitally important that no matter what type of program you are in as a homeschooler, be it a charter school, a religious program, or on your own, that you understand your State?s laws pertaining to homeschooling.? Most states allow homeschooling, but the regulations governing the implementation and execution of homeschooling vary greatly.? One state might allow require physical education, another might not.? One state may allow electronic transmission of records, another may require it by mail or fax.? The list goes on.? I would highly recommend that you find out for yourself what your state?s educational laws and regulations require of you as a homeschooling parent.? I would also recommend that if you do not know where to find this information you should be able to ask your homeschooling contact (education consult, teacher, proctor, charter school, or whatever your program calls it) to explain the rules or provide them to you.? You never know what you might find in your rules and how often the rules may be changed; just remember to know how they apply to your family. What would this world be like without YouTube?? Seriously though, how many times have you read a blog and it links you to a video? I know that I reference YouTube and other video options (like a DVD from your local library) in my blog posts.? I also rely on videos in my homeschooling day.? It is not every day that I use a video, but I know that brick and mortar school use them, so why not us homeschoolers, right?? Just make sure that you are not relying on videos all the time.? There is no substitute for teaching your children efficiently, so I sometimes use educational videos to emphasize my curriculums.? Are you teaching about a historical figure?? There is probably an official site about that person with imbedded links, why not use it? Are you teaching about an event that has happened? There is probably a video, CD, news snippet, or DVD about that person out there, why not use it? I would just highly recommend previewing and loading it first since there seems to be less and less controls on the content out there in cyberspace.? Be safe and view it first so that you can verify that it is what you want it for, assuming you do not trust the source already.


Why did you choose homeschooling?? This is a question I get all of the time.? I can go on-and-on about the positives and negatives, but I think the best reason to choose homeschooling is for you to decide for yourself.? I think that my answer is all encompassing and I talk about it on my about page found HERE. The reason that you should choose homeschooling will be yours and yours alone and please do not let anyone tell you any different.? Each family is different and homeschooling can be a great environment for you to teach your children, grow as a family, and provide the best environment for your children to grow into great adults under your influences.

A common phenomenon that is sometimes unavoidable in the homeschooling world is the constant comparison to other homeschool family routines, other curriculum?s, one family?s version of extracurricular activities and so on. Thanks to the digital age and homeschooling building such a large online community and presence this phenomenon has become even more prevalent. While we all would love to put on a pair of X-Ray goggles and stand outside the home of a homeschooling mom that we may envy, there is something important to be learned from this. While watching another homeschooling parent can be a lot of fun and you can gain insightful ideas that you can implement into your own homeschool please remember the old adage, ?If it ain?t broke then don?t fix it?. Just because you see something in one family?s routine that ended up not working in yours it does not mean that they are doomed to the same results as when you did it.? You might also see something that totally failed you in your situation working wonders for theirs.? It is hard to remember that each family is made up of different people, personalities, circumstances, and different sets of situations. It is often hard to say what works and what does not because I do not get to wear the X-Ray goggles that often, but I know what has worked for me and it has come from trial and error.? Do not be afraid to try something and then if you end up realizing at some point that it isn?t working or it isn?t doing what you thought it was, try something different.? It goes the same with others that we interact with.? Do not be afraid to give your honest opinion on something, but remember that each situation is different for those involved in it and they might not be looking for your opinion either.?

So, when it comes to homeschooling, I see a lot of great things out there that I pin or move to implement in my own homeschool, but I also see a lot of things that make me think, wow, how the heck or why do they do that? I try not to put on the X-Ray goggles and then pick apart what I am seeing, but rather on those rare cases where I do get my turn of using the X-Ray goggles, I try to see how it would work or fit into our homeschooling journey.

Record keeping?? What is that?? Why do you have to keep records you ask? The best reason is that you never know when or who will ask you for them in an official capacity.? The records that we keep are to document by keeping proof that your student has met their education objectives. Because larger schools can produce records at the drop of a dime, so should we as homeschoolers.? This also means that those schools will also have tried and true methods of what to keep.? As homeschoolers we need to determine what the state laws and regulations are and keep records that illustrate our students meet those requirements.? Although it is not always the case, a lot of regulators may view homeschooling records with skepticism and that can lead to a lot of heart burn if you have not kept enough records.? I have often heard the mantra that whether it is correct or not, the more records you keep (and examples of work) the more likely you will be to overcome the skepticism.? As a parent your record keeping will be vital if your consultant or teacher looses, misplaces, or simply does not get enough samples to justify your progress.? I tend to keep extra samples of my children?s work in a spare printer paper box so that I have my own records and samples of what I have turned into my homeschooling fairy.? Do not get me wrong, I do not keep everything, but I do tend to keep more than my fair share.? It is also important to remember that not only are you keeping these examples and samples for your records, but you are also keeping them for yourself as keepsakes too!
So, now that it has been established that it is indeed a good idea to keep records, what type should we keep?? I would recommend keeping the following times (you might come up with more): Daily attendance, grades, test scores, reading logs, PE logs, accomplishments, accolades, examples that meet specific standards, official letters, proof of grade advancement, education agreements and so on.? The most important thing to remember is that even if you are not required to keep records, it is always a good idea to keep them anyway to prevent any issues later down the line. And remember that you only need to keep enough records to substantiate the homeschooling education you have completed.? The length of time to keep those records varies, but I would recommend keeping them for about four years during the lower grades and permanently once they get into junior high and high school.? I would also strongly recommend looking into your state laws concerning high schoolers since some will be applying for colleges, military careers, scholarships, work programs, and the like.? Keeping records might not be the thing about homeschooling you want to do, but you must keep records to protect the hard work that your homeschoolers are doing each day, not the mention the dedication you are providing to them as their parent and teacher.

Do you have a Zoo in your community?? I know that we have a local zoo and it is always a blast to go.? In the past I have even had a yearly pass to ours and we went every few weeks.? The kids had a blast learning about the animals.? What they did not realize at the time was that I was planning days at the zoo around their school lessons and was supplementing their learning with real live animals.? At one time we were learning about tigers so I made sure the next time we went to the zoo to have the kids ask the tiger keepers about the tigers.? Then, the next day when we started learning about tigers they really connect because the spent the previous day learning about them already.? It was great to see the children build on their hands-on knowledge with classroom exercises too.

Also keep in mind that most zoo?s give discounts to students and teachers (see my I is for ID cards section of this series) so do not be afraid to let the ticket booth workers know you are a homeschooling family.? You can also look into your local zoo because most will have educational programs for schools.? Since you are a teacher you should be able to tap into their educational resources for your homeschool too, your children.? Then, when you are at the zoo next you can sometimes participate in the learning events, special education themed shows, and special school themed behind the scenes that any school child would love to be part of.? Remember, because you are a homeschooling family means that you have a teacher and student in the same place and most zoos require teacher and student involvement.? Zoos are a great resource in my opinion.
